Terms of service

These terms apply when you buy or use Bitsmith. By purchasing a license or installing the software, you agree to them. Bitsmith is built by Hungrimind.

Your license

A Bitsmith license lets you run the software on one server for as long as that license is active. You can move the license between servers from your dashboard. Running it on additional servers requires additional licenses.

The license includes every feature, every app in the library, and every future update we publish. There is no subscription. The price you pay is the price you pay.

Refunds

If Bitsmith isn't what you wanted, email robert@hungrimind.com within 30 days of purchase and we'll refund the full amount. No forms, no questions, no exit interview.

Eligibility

You must be at least 18 years old (or 16 in the European Economic Area, with parental consent if younger) and legally able to enter a contract in your jurisdiction. By buying a license you confirm both of these are true.

Acceptable use

You agree not to:

• Redistribute, resell, or sublicense the Bitsmith software
• Reverse engineer, modify, or attempt to bypass the license check
• Use the software to violate the law or third-party rights

You're responsible for the content stored on your server and for keeping the host machine and its network safe. We don't operate or audit your server.

Open standards underneath

Bitsmith runs on top of standard tooling — ZFS or ext4 for files, Docker for apps, SMB for shares. If we ever stop publishing updates, your data and apps stay where they are: in formats anyone with a Linux box can read.

Suspension and termination

We can suspend or revoke a license if it's used in a way that breaks these terms, or if a payment is reversed. If we revoke a license, the software on your server will stop validating and will eventually lose access to gated features. Your files and data on the server are unaffected — they live on your hardware.

You can stop using Bitsmith at any time. Refunds outside the 30-day window are at our discretion.

Updates and availability

We aim to keep the cloud services that support Bitsmith (account dashboard, license verification, install endpoint) running, but we don't guarantee uptime. If a cloud service is down, the Bitsmith software on your server keeps running on its cached license for a grace window so the box doesn't break because of a network blip.

Warranty disclaimer

Bitsmith is provided as is, without warranty of any kind, express or implied. To the extent allowed by law, Hungrimind disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the extent allowed by law, Hungrimind's total liability arising from these terms or your use of Bitsmith is limited to the amount you paid for the license in the 12 months before the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Hungrimind LLC and its officers, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of Bitsmith, your content stored on your server, your violation of these terms, or your violation of any third-party right.

Changes to these terms

If we change these terms, we'll update this page and bump the "last updated" date. Material changes that affect existing licenses will also be emailed to license holders.

Governing law and jurisdiction

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles. Any dispute arising under these terms or your use of Bitsmith will be resolved exclusively in the state or federal courts located in Laramie County, Wyoming, and you agree to that venue.

Hungrimind LLC is a Wyoming limited liability company with a registered address at 1021 East Lincolnway, #7739, Cheyenne, WY 82001, USA.
